Terms and Conditions

Pilcha is a tool that, from a photo you upload voluntarily and some body data (sex, age, weight and height), generates an approximate image of how a garment might look on you and suggests a recommended size. The Service is a visual, orientative aid: it does not replace physically trying on the garment or the brand’s official size chart.

The images produced by the Service are generated by artificial intelligence and are an estimated representation, not a real photograph of the product worn on your body. Fit, colors, textures and proportions may differ from the actual result. The size recommendation is an automated estimate based on your data and may not be exact. We do not guarantee that the garment will fit as shown or that the suggested size is correct. The purchase decision is always yours.

Uploading your photo is voluntary and is used solely to generate your virtual try-on. Processing works as follows:

• The photo you upload (your selfie) is deleted as soon as we generate your result. We do not keep it once the try-on is done.
• The generated image is deleted automatically after a short time (around one hour), unless you choose to save your look (see point 4): in that case we keep it until you delete it or ask us to remove it.
• To create your try-on, we process the image through our artificial intelligence provider (Google Cloud Vertex AI), located in the United States, only for that purpose and for the time needed to generate the result. We do not use your photo to train artificial intelligence models.

You agree to upload only photos that are your own or that you have the right to use; do not upload images of third parties without their consent, or illegal, offensive or infringing content. Full details of how we handle your data are in our Privacy Policy.

We process your data in accordance with the applicable personal data protection regulations (in Argentina, Law 25.326; in Brazil, the LGPD; and any other applicable rules). By default we do not save your try-on: unless you choose otherwise, your result is deleted after a short time and you receive no communications.

Within the Service you can enable, by ticking the corresponding option (never enabled by default), saving your look and your measurements so you can view it again, improve future recommendations and receive by email your result and communications from the brand. This option is voluntary and you can revoke it at any time.

Separately, we may keep your body data (sex, age, weight, height) and the suggested size associated with the try-on, for statistical and Service-improvement purposes. You can request access, rectification or deletion of your data, and revoke your consents, by writing to javier@pilcha.ai.

The Service is intended for adults. If you are a minor, use it only with the authorization and supervision of your mother, father or legal guardian, who must give consent for the processing of your data.

The Service, its software, trademarks and designs belong to Pilcha. You retain ownership of the photo you upload. The generated image is provided to you for personal, non-commercial use; if you share it (for example, on social media or messaging), you do so under your own responsibility and the data becomes subject to the terms of the platform you send it to.

The Service is a tool. The image you generate is for your personal use, and the responsibility for how you use it is exclusively yours. You agree not to use the Service or the generated images for unlawful, offensive or harmful purposes, including but not limited to:

• mockery, harassment, stalking, defamation, discrimination or any form of violence toward you or third parties;
• creating, sharing or spreading humiliating, non-consensual sexual, misleading content, or content that could harm a person’s image, honor or dignity;
• impersonating third parties or generating images of people without their consent;
• any use contrary to the law, morals or good customs.

Neither Pilcha nor the store (e-commerce) that integrates the tool is responsible for any misuse that you or other users make of the generated images. That responsibility rests fully and exclusively with the user who generates, downloads, shares or distributes them. Pilcha may suspend or limit access to the Service in the event of uses that violate these Terms, without prejudice to any applicable legal action.

We make reasonable efforts to keep the Service working well, but it is provided “as is”, without guarantees of uninterrupted availability or absence of errors. We may modify, suspend or discontinue features at any time.

To the maximum extent permitted by law, Pilcha will not be liable for indirect or consequential damages arising from the use of the Service, nor for purchase decisions made based on the generated images or recommendations, which are orientative in nature. Nothing in these Terms limits or excludes the rights that consumer protection law grants you on a mandatory basis.

We may update these Terms. The current version is the one published on this page, with its last-updated date. Using the Service after a change implies acceptance of the updated version.

These Terms are governed by the laws of the Argentine Republic and, in the event of any dispute, the parties submit to the competent ordinary courts of the Autonomous City of Buenos Aires. This does not affect the mandatory rights that consumer regulations grant you: if you are a consumer, you may file a claim before the authority and courts of your own domicile, and consumers in Brazil are covered by the protections of the Consumer Defense Code.
