Privacy Policy

When you use the try-on within a brand’s store, that brand (the merchant) is the data controller of your data, and Pilcha acts as a processor/operator that handles it on behalf of the brand and in accordance with this Policy. As for the operation of the tool itself, Pilcha determines the technical means described here.

For any privacy questions or to exercise your rights, write to hola@pilcha.ai.

• Your photo (the selfie you upload voluntarily).
• Body data: sex, age, weight and height, which you enter to calculate your size.
• The image generated by the AI and the recommended size.
• Your email, only if you choose to save your look and receive communications (see point 4).
• Technical and usage data: a derived and truncated identifier from your IP address (we do not store the raw IP), your device/browser type and try-on usage events (for example, that it was opened or that a try-on was generated), for statistical purposes.

The photo and body data may be considered sensitive information. that is why we only process them with your consent and for the purposes described here.

• Generate your virtual try-on and recommend a size — legal basis: your consent.
• Save your look and send you email communications — only if you enable it. legal basis: your consent, revocable at any time.
• Statistics and Service improvement (aggregated or associated with the try-on) — legal basis: legitimate interest and/or your consent, as applicable.

The size recommendation is an automated decision: you have the right to request human review or more information about it (see point 7).

• Your selfie is deleted as soon as we generate your result. We do not keep it once the try-on is done.
• The generated image is deleted automatically after a short time (around one hour), unless you choose to save your look, in which case we keep it until you delete it or ask us to remove it.
• Your body data and the suggested size may be kept associated with the try-on for statistical and improvement purposes. you can request their deletion.
• Your email is kept while you keep the option to receive communications active; you can unsubscribe or request its deletion whenever you want.

We do not use your photo to train artificial intelligence models.

We do not sell your data or share it for third-party advertising purposes. To provide the Service we rely on providers that act as processors and handle the data only on our instruction:

• Google Cloud (Vertex AI) — processes your photo to generate the try-on image. Location: United States.
• Amazon Web Services (S3) — temporary storage of the images while the process runs. Location: United States.
• The brand (the merchant) in whose store you use the try-on, as data controller.

International transfer. Since some of these providers are in the United States, your data may be transferred outside your country. We carry out those transfers on the basis of your consent and/or contractual clauses and adequate safeguards in accordance with Law 25.326 (Argentina) and the LGPD (Brazil).

We apply reasonable technical and organizational measures to protect your data (encrypted connections, signed short-lived upload URLs, deletion of the original photo after processing, and data minimization). No system is 100% foolproof, but we work to reduce the risks.

You can exercise, at any time and free of charge, your rights of access, rectification, updating, erasure (deletion), objection, portability, as well as revoke your consent and request human review of the automated size recommendation. To do so, write to hola@pilcha.ai. We will respond within the timeframes set by the applicable regulations.

If you believe your rights have not been respected, you may file a claim with the supervisory authority: in Argentina, the Agency for Access to Public Information (AAIP); in Brazil, the National Data Protection Authority (ANPD).

The Service is intended for adults. We do not intentionally process minors’ data without the consent and supervision of their mother, father or legal guardian. If you detect that a minor used the Service without that authorization, write to us so we can delete their data.

We may update this Policy. The current version is the one published on this page, with its last-updated date.
